Trump Speech to Congress Focuses Little on Energy, Climate

In his first address to Congress Tuesday night, President Donald Trump touted accomplishments since taking office in January—including withdrawing from the Trans-Pacific Partnership, ordering construction of the Keystone XL and Dakota Access pipelines and nominating conservative Judge Neil Gorsuch to the Supreme Court. Crime, immigration, trade and health care dominated the speech, with little focus on energy and climate issues.

What Trump did make clear is his direction on regulation and infrastructure. Trump’s comments on Tuesday, ClimateWire reports, reaffirmed his desire to help coal miners and the idea that his policies are based largely on rolling back environmental regulations. Reuters reports that according to an unnamed White House official, Trump could lift a federal coal mining ban and an initiative forcing states to cut carbon emissions, in an executive order as soon as next week.

“We have undertaken an historic effort to massively reduce job-crushing regulations, creating a deregulation task force inside of every government agency,” Trump said. “And we’re imposing a new rule which mandates that for every one new regulation, two old regulations must be eliminated. We’re going to stop the regulations that threaten the future and livelihood of our great coal miners.”

Although Trump vowed “to promote clean air and clear water” in his speech to Congress, the same day he issued an executive order for reexamination of the Waters of the U.S. rule. Written by U.S. Environmental Protection Agency (EPA) and the Army Corps of Engineers and finalized in May 2015, the rule was meant to clarify the reach of federal regulators over wetlands and waterways under the Clean Water Act (subscription). The order directs the EPA and the Army Corps of Engineers to begin a formal rule review, the first step in what legal experts say is a lengthy process to rewrite or repeal the rule—a process that could take longer than one presidential term.

EPA Cuts Signaled in Trump’s Proposed Budget

President Donald Trump’s first budget proposal, sent to government agencies on Monday, would increase defense and security spending by $54 billion and strip roughly the same amount from non-defense programs, with some large cuts to come from the U.S. Environmental Agency (EPA).

If enacted, the proposal could slash as much as a quarter of the EPA budget, shrinking programs introduced by the Obama administration—for example, EPA regulations on the fossil fuel industry.

A source told CNN that the Clean Power Plan, which would reduce carbon emissions from fossil-fueled power plants, is facing potential elimination, along with other regulations to curb greenhouse gas emissions. They include 14 EPA partnership programs to reduce those emissions and Global Change Research, a program funded by several agencies, including the EPA, which reports humans’ impact on the planet.

Although the EPA is a perennial target for budget cuts for some conservatives in Congress, the purported cut, which would amount to about $2 billion from the EPA’s annual budget of about $8.1 billion, is not a certainty. Approximately half the EPA’s annual budget goes to popular state-level programs, like converting abandoned industrial sites into public facilities, and most of the EPA’s federal office spending goes to funding programs that are required by existing laws.

Just four days beforehand at the Conservative Political Action Conference in Washington, D.C., EPA administrator Scott Pruitt said those who want to eliminate the department are “justified” in their beliefs.

“I think it’s justified,” said Pruitt. “I think people across this country look at the EPA much like they look at the IRS. I hope to be able to change that.”

Pruitt, who fought two cases that led to courts freezing the Clean Power Plan and the Waters of the U.S. rule, also told conference attendees that he would “restore federalism” by giving states a greater say in air and water protection and ensure that “regulations are reined in.” He demurred on the issue of the EPA’s cross-state pollution work, but said the EPA “can’t just make it up” when it decides rules to address climate change, adding that it is “hard to measure with precision” the impact of human activity on the changing climate.

California Acts to Keep Its Environmental Standards

Last Thursday, lawmakers in California introduced three bills—the “Preserve California” package—that made it clear that they want to continue the state’s stringent environmental and climate change policies. The attempt to insulate the state from potential rollbacks in federal environmental regulations and public health protections could set up a battle with the Trump administration and Congress.

“We’re not going to let this administration or any other undermine our progress,” said California Senate Leader Kevin de Leon. “Washington may choose to double down on dirty energy, but California will not follow.”

One of the three bills, SB49, would make current federal clean air, clean water, endangered species and workers’ safety standards enforceable under state law, even if the Trump administration weakens federal standards. With respect to air standards, it would require local air districts to comply with federal rules for new stationary pollution sources in place as of January 1, 2016, or January 1, 2017, “whichever is more stringent.”

California has been relying on federal waivers from the Clean Air Act to set its own, stricter, clean air standards, but the U.S. Environmental Protection Agency could theoretically rescind those waivers or refuse to renew them.

SB50 establishes a new state policy to discourage transfers of federal lands to private developers for resource extraction and directs the State Lands Commission, which oversees many of the federal lands in California, to give the state right of first refusal of any federal lands proposed for transfers to other parties. The state would review any transactions involving federal lands in California to ensure those lands are protected, by state action if necessary.

SB51 would extend whistle-blower protections to federal lawyers, engineers and scientists who are working in California and would direct state environmental and public health agencies to preserve data, even if federal authorities order it to be censored or destroyed.

EPA Delays Release of Carbon Emissions Rules for Power Plants

The Environmental Protection Agency (EPA) is delaying the release of carbon emissions rules for all power plants and will publish them for new as well as existing plants at the same time mid-summer.

“It’s become clear to us … that there are cross-cutting topics that affect the standards for new sources, for modified sources and for existing sources, and we believe it’s essential to consider these overlapping issues in a coordinated fashion,” said Janet McCabe, the EPA’s acting administrator for air quality.

McCabe also announced that the EPA will begin drafting a “model rule” for states that do not submit individual plans to meet emissions reduction targets in the existing power plant regulations.

Under the proposed regulations for new sources, the EPA has functionally required new coal power plants to include carbon-capture technology, which critics of the emissions rules say lack proof of efficacy on a large scale and have a high cost to implement. In 2011, the American Electric Power Company reported that including carbon-storing processes at a West Virginia plant would cost an estimated $668 million.

California Cap-and-Trade System Includes Oil and Gas Sector

California’s cap-and-trade program—the country’s first multi-sector carbon emissions trading program—now requires gasoline and diesel producers to supply lower-carbon fuels or to buy carbon allowances—pollution permits—for the greenhouse gases emitted when those fuels are burned.

Key program stakeholders, industry leaders, public officials and environmental advocates agree that consumers will see a rise in gas prices, but the amount remains uncertain.

“There’s a very large universe of variables which could affect gas prices on a daily basis, and we don’t set fuel prices,” said California Air Resources Board spokesperson Dave Clegern. He added, “We don’t see them going up more than a dime, at the most, based on any current cap-and-trade compliance costs.”

It is estimated that 25 percent of secured funds from the emissions trading program will be allotted to the state’s high-speed rail project.

California’s program includes an allowance reserve initially proposed by Nicholas Institute and Duke University researchers that prevents carbon allowance prices from reaching levels beyond the scope of purchasers.

Congress Prepare to Vote on Keystone XL Pipeline

The Senate Energy and Natural Resources Committee has cleared legislation to approve the Keystone XL pipeline, which would deliver some 830,000 barrels of oil a day from Canada’s oil sands to Gulf Coast refineries. But White House press secretary Josh Earnest, citing the Obama administration’s “well-established” review process, said, “If this bill passes this Congress, the president wouldn’t sign it.”

The pipeline has become a flash point in the debate over climate change and economic growth.

In a December 19 press conference, the president said, “I want to make sure that if in fact this project goes forward, that it’s not adding to the problem of climate change, which I think is very serious and does impose serious costs on the American people, some of them long term, but significant costs nonetheless.”

Critics of Keystone have pointed to the carbon intensive production of the crude it will carry. In an op-ed in The Hill, the new president of the Natural Resources Defense Council, Rheh Suh, called production of oil from Canadian tar sands an “environmental disaster.”

Supporters argue that Keystone will be a source of economic stimulus. In a statement, Energy and Commerce Committee Chairman Fred Upton said, “After six years of foot-dragging, it’s time to finally say yes to jobs and yes to energy. It’s time to build [this pipeline].”

Cutting Oil Use Should Be Focus of U.S. Energy Research, New Roadmap Says

A major study modeled after goal-setting reports from the Departments of Defense and State, the first Quadrennial Technology Review by the U.S. Department of Energy (DOE), called for a shift in energy research and development priorities to reduce America’s dependence on oil.

“Reliance on oil is the greatest immediate threat to U.S. economic and national security and also contributes to the long-term threat of climate change,” the report said.

The DOE spends about $3 billion annually on research and development, with about three-quarters of that going toward “stationary energy” technologies—such as power plants and buildings—and one-quarter allotted for transportation. The report’s release could shift the funding balance more toward transportation, in particular more efficient cars and electric cars.

It will likely shape the 2013 fiscal year budget request from the Obama administration, due to be sent to Congress in February 2012.

Big Dreams

But a longer-term view isn’t synonymous with funding blue-sky ideas, as in the DOE’s Advanced Research Projects Agency-Energy (ARPA-E), which Time dubbed “the Department of Big Dreams.” The Quadrennial Technology Review criticized the DOE for placing too much emphasis on technologies “multiple generations away from practical use.”

Instead, the report called for greater focus on integrated energy systems and deployment over the medium to long term. The Obama administration has no choice but to focus on the longer term, argued Jeff Tollefson of Nature, because the weak economy and political stalemates have stymied progress in the shorter term.

The report sticks close to President Obama’s goals: getting one million electric cars on the road by 2015 and cutting oil imports by one-third by 2025. It also focuses on modernizing the electric grid and deploying clean energy, in line with Obama’s goal for 80 percent for America’s electricity to come from clean sources by 2035.

Carbon Credit Controversy

WikiLeaks has once again stirred up controversy, this time by releasing a diplomatic cable sent by the U.S. embassy in India, revealing discussions about questionable projects there that earn carbon credits through the United Nation’s Clean Development Mechanism (CDM).

Most of the CDM projects in India should not have been certified, the cable said, because they did not achieve emissions cuts beyond what would have happened without the sales of carbon credits.

The cable shows “the CDM is basically a farce,” said a group critical of the program, but officials involved in the program said it has been improved since the cable was sent in 2008.

However, an investigative series last year by the Christian Science Monitor found many instances of fraud and exaggeration. And last week Oxfam published a report alleging 20,000 people were evicted from their land in 2010 to make way for a tree plantation that would earn carbon credits.

Superconductor Espionage

American Superconductor, which designs magnet systems for wind turbines, alleges that Chinese turbine manufacturer Sinovel, its largest customer, stole trade secrets by bribing a disgruntled employee, one of a handful with access to a crucial bit of software.

A court in Austria is hearing the case, in which Sinovel stands accused of offering the rogue employee an employment contract worth at least $1 million. The employee only received a small fraction of what he was promised, and American Superconductor sent Sinovel many parts also without receiving payment.

Sen. John Kerry said such theft would hurt American investment in China.

Master of the Domain

With the internet opening to new domains, there has been a tussle over who will control the .eco domain, with Al Gore’s Alliance for Climate Protection vying against the Canadian company Big Room, supported by former Soviet leader Michel Gorbachev’s charity Green Cross International.

Al Gore’s group has dropped its bid, after many green groups—including 350.org, Greenpeace, and WWF—backed Green Cross International. The new domain is intended to be a badge of credibility, said the co-founder of Big Room, and may require disclosure about environmental performance when registering to use the domain.
